I’m Robert J. Frank. I am a candidate for the position of Justice of the West Virginia Supreme Court. I have spent my 28-year legal career representing ordinary people facing family law issues. The experiences I have are necessary in a West Virginia Supreme Court Justice.
The people of West Virginia have lost confidence in our state’s highest court. Too often Justices and candidates to be Justices seem disconnected; their experiences very different from those of the rest of us. Too often their legal backgrounds, which may be impressive on paper, don’t seem to apply to the issues which face ordinary people. West Virginia needs Justices who have helped ordinary people overcome extraordinary legal challenges; Justices who know what ordinary people face, and who know how their decisions will impact the lives of people affected by their decisions.
The trial courts of West Virginia, both Family and Circuit Courts, face a heavy caseload of family related cases; divorces, child custody, dependency and neglect. These issues are exacerbated by an out of control opioid epidemic. Yet some of the candidates running for Justice of West Virginia Supreme Court have little experience representing ordinary people facing the extraordinary burdens of a divorce or child related case. If you are going through, or have ever gone through a divorce or child custody matter, do you really want to elect as a Justice an attorney with no experience or little experience in child custody cases?
On any given day, you can look at the shelves containing my case files and see a large docket of family law cases. You may find cases that range from pro bono cases for families that do not have the resources to hire an attorney to multimillion-dollar divorce estates. You will see multijurisdictional custody cases, spousal support cases, cases involving complex medical issues, and cases involving the division of business and professional practices. You will see clients young and old, men and women, black and white, rich and poor. I have real experience, representing real people, facing real problems.
